High Court Compensation Settlement For Hospital Failings
An eight million pound compensation claim has been granted by the High Court in London after a hospital admitted to deficiencies during the birth of a baby in 2006.
Following his birth, the staff present were required to resuscitate the baby but this was not handled correctly and there was a failure in the provision of ‘adequate treatment’ for him.
Serious Brain Damage Resulted
The error caused by the hospital staff who were present at the birth of the boy who is now eight resulted in serious brain damage and the youngster now has cerebral palsy, profound learning difficulties as well as being unable to speak or walk. According to the lawyers who represented the boy’s family, the youngster needs teams of carers to look after him.
Hospital Admitted Liability
The hospital trust admitted liability for the boy’s condition and the barrister representing it apologised to the family for the errors which had been made.
Hospital Taken Steps To Improve
Since the incident, it was noted in court that the hospital responsible for the errors had taken steps so that other families were not put through the same difficulties in the future.
The Chief Executive of the hospital trust said:” Whilst no amount of money can compensate for, nor undo the harm and distress the family have experienced as a result of this tragic case, we hope this settlement provides the family with financial security for the future.” The settlement is intended to meet the financial needs of the boy for the rest of his life. The presiding judge said that he felt the compensation settlement was fair and he also acknowledged the dedication of the boys’ family in terms of the care they provide.
