How does Uber work and how is it different from traditional taxi firms?

Ride-sharing platforms have become people’s go-to service instead of taxi companies. It has, historically, argued that their drivers are self-employed contractors as opposed to workers. This has resulted in making it hard to define who is responsible when one of their drivers is involved in a road traffic accident.

The question of their drivers’ working status has been at the centre of a long legal battle over the last few years. In December 2018 the Court of Appeal ruled that ride-sharing drivers should be considered workers in a landmark decision. This outcome has meant that it is now mandatory for ride-sharing companies to ensure that their employees are safe. They have a responsibility to check that their cars are fit for purpose and that proper insurance is in place. All organisations have a duty to keep consumers safe and if this has not been carried out then you may have the right to claim compensation.

Steps to take if you have been involved in an accident

It is a good idea to gather as much evidence as possible to support your claim. This could mean:

    1. Get yourself to a safe area. Exchange contact details with the other party, and make a note of the registration number of their vehicle.
    2. If there were any witnesses to your accident, try to gather their details.
    3. After leaving the scene of the accident, visit your GP, or if your injuries are serious, go to A&E.
    4. Next, make sure you report your accident to the police.
    5. Following your accident, keep a record of the costs you have incurred as a result of your injury by keeping receipts. If you take legal action, you may be able to claim these expenses back.

    Uber accident claim settlement amounts

All personal injury cases are unique and so the amount of compensation that is awarded in each case is also unique. The amount of compensation that is awarded is determined by looking at two distinct factors – general damages and special damages.

    GENERAL DAMAGES

The pain and suffering that your injuries have caused is the main factor that is used to determine how much compensation you are owed.

    SPECIAL DAMAGES

However, compensation also takes into account any financial losses that you might have suffered as a result of your injuries, such as a loss of earnings due to being unable to return to work.
